Hi all, my husband and I decided to call it a day and go forth with separation. We are in the process of separating all out belongings, etc as we have to live in the same council house until my husband found an accommodation somewhere else.
My husband works full time and gets paid weekly whilst I do not work due to ongoing CBT and receive the lower DLA until I can go back to work one day. He already told me that he will not pay me any maintenance to myself as we have no children. His home take pay is £325. However divorce is to expensive for us both in the moment.
I searched everywhere for an answer today online but without success. Will I still get my benefit and now that I live separate from my husband are even more entitled to housing benefit and council tax. How much of the bills has he got to pay?
Apart from having a £650 debt, which gets paid by my husband on a weekly basis of £20, we do not have further debts. He needs to save money up so he actually can move out.
I would welcome any suggestions or even answers please.
Thank you

Once he moves out as their are no children he will not have to pay anything towards your keep or bills, who`s name is the debt in?You will need to apply for h/b(or lha if you rent privately and ctb),i would also have thought you would qualify for ibesa if you are unable to work,or jsa when you are looking for work0

When you say "will I still get my benefit", do you mean DLA? If yes, you will still get it if you meet the criteria.Sealed pot challenge #232. Gold stars from Sue-UU - :staradmin :staradmin £75.29 banked

Income based employment support allowance. This is the benefit that replaced income support (IS) for reasons of incapacity, for those who haven't paid enough national insurance contributions.Sealed pot challenge #232. Gold stars from Sue-UU - :staradmin :staradmin £75.29 banked

He should go for a legal separation document, IIRC that isn't terribly expensive and you can use it to explain your circumstances to the benefits agencies.Declutterbug-in-progress.⭐️⭐️⭐️ ⭐️⭐️0

If your husband is still living in the same property as you, they may need to make a decision on you living together as a couple.0
