returning a mobile phone

my friends phone was due for an upgrade and after visiting the 3 store was given a nokia. however, when she got home she realised it was too complex for her to use (she was persuaded by staff that this was the best phone - she was given the choice of pretty much any phone in the shop)

so after another visit tiothe store today she was able to swap her phone but could only chose from a couple of basic models

neither phone has been used or even had a sim card put in it. does abyone know if she could change or return this phone, or be able to cancel her contract and go elsewhere if the wont help

I doubt very much if she will have any success in getting a refund and she can't of course cancel a contract without paying it of fin full first.

I'm not actually with 3 so cant really comment on their service but the o2 shop I bought my contract from had a 7 day pereiod where if you change you mind, you can return the phone and change it for another one. (I am also on contract)

If your friend has been with 3 for a long time on contract, s/he could try and appeal to their better nature and maybe they'll change the phone as a gesture of good will?
