Query about NPB

Could I have some help or advice please.
I won an item on Ebay on 18 November, and it was alleged the item was posted on 21 November. Well it came to December, and nothing arrived (parcel coming from brasil).
I emailed seller, and he said that he had sent the item, he had proof, he said you can claim a refund, but when it is delivered I will issue you will a npb.
Now I know that 45 days is the cut off for filing for a refund (as I read through this board). I filed a claim on the 44th day.
I thought an extra 10 days, if it turns up brill, cancel the claim, but nothing did turn up, and the seller did not respond to paypal dispute (did not show any evidence not even respond to me, nothing). I got the refund.
I didn't leave any feedback because the 60 days are up.
Now there is this nagging doubt in the back of my mind, what if the item turns up, not saying it will, but what if.
Does the seller then have right to a npb, or is there a time limit on when he can do a npb against this item.
Also, in the remote case, the item does turn up, should I refuse delivery of the item. I am a little frightened of the gentlemen because when I asked for a refund when the item did not turn up, shall we say he was not very polite.
Personally the is lost, but I would just like to put my mind at rest.
