can i get a refund?

Hi all I wonder if you can help me with this I bought a bath spa for my girlfriend from amazon, on the website it says nothing about the requirements for setting it up. It turns out that there isnt room in the bathroom for it however the only way to find this out was to open the packaging to read the user manual. However when i came to return the item for refund I read it says to return all the seals and shrink wrap must be in place does this apply to the polythene bags companies wrap things in can i get a refund?

Yes, you you can get a full refund under the Distance Selling Regulations as long as you cancel, in writing, within 7 days of receiving the item. In this case it won't matter that you've opened the packaging as you are allowed to inspect the product. Bear in mind you will have to pay the costs of returning it. The retailer's T&Cs do not overwrite your statutory consumer rights.

Oh no, Im outside the 7 days as it was a gift for her birthday so i think im in a bit of bother unfortunately. thanks alot neilmcl its a bit of a bummer as was expensive, il bare that in mind for next time.

if you contact them & explain it was a Christmas present, they may still take it back? Gotta be worth a try
