Help -Fence problem with builders

I have bought a property -leasehold from a leading builder. 3 months later we got a letter that garden fence needs to be moved both infront and back more than 2 metres inside our garden .This will make our garden very small .Fence came with the property at the time of buying. We were among the first to buy the houses on the new estate.When I wrote back they have quoted a clause that the extra property is of council and the fence is on council property and needs to be put on the right place.
We had other properties to buy at that time had I known this problem.Do I stand to get any compensation?

Check with your solicitor. From what you are saying you bought a house with a certain size garden and the developers didn't actually own the land to sell to you. If they sold you this land and now need to give it back to the council I would be argueing that they need to buy it back off you.I'm a Forum Ambassador on the housing, mortgages & student money saving boards. Yes ,that is right.But here is clause int the deed that if the fence is at wrong position then its position will be changed.I feel angry as I feel cheated .I will contact solicitor tomorrow.

Ther has got to be a difference between the fence being in the wrong position (ie minor) and completely the wrong place! I would have thought the plans they provided your solicitor with have to be accurate to a certain level.
