capital one partial win help please

today i recieved 2 letters back from capital one regarding my 2 credit card with them and my claim for ppi on them both

i had already had the statutory(were not paying letter) a few months ago but decided to reply stating im not happy and hopefully get a better responce

on 1 of the cards they have offered me (a goodwill gesture) of a full refund and stated this is their final responce (which i will accept) good result

the other responce is slightly different and this i would apriciate advise on please

the same blah blah blah to start with and the goodwill gesture

but they are only offering me a partial refund and no message anywere on the letter of this being their final responce

i must add the 1st card of full payment was an internet aplication and the partial refund was a phone aplication

is worth fighting this as dont want to get a responce saying its been withdrawn and i may go to fos as the sum is £200 and would come in handy

i have no idea how much the figure should be as both cards were payed off a few yrs back and i just sent letters to all cards on offchance i may get lucky

any help apriciated

dave

    Hi Dave

I think if you accept a partial payment, you may still be able to go to the FOS for the remainder, maybe someone will clarify on this, good luck.;)

  • If your complaints are upheld you should receive a refund plus interest.

Generally, if you accept it will be in "full and final settlement" and FOS will not look at it unless you can persuade them that the redress was insufficient and you were not aware of this at the time you accepted.
