Capital One Settlement Problem!

Hi Guys!
I'm new to moneysaving expert and need some advice from the pros!
I have received a Settlement Form from Capital One on 23rd December 2009 and sent this back on 4th January 2010. It was for £1361.32 for default sums on my account.
They have called me today and have said that a member of staff has made an error and they have not taken into account charges I successfully reclaimed in 2008.
The settlement form is on headed paper and signed by a member of staff, do I challenge this or just accept it as human error??

Ask them to see proof of this.
However, were you aware of how much you were claiming and did you receive an amount in 2008?
Can you check your paperwork to see if this is true. If it is then you have to accept that their offer was made in error in spite of this.
Make sure that what they are saying is correct before agreeing with them but ask for the explanation in writing,0 -
Honesty really is the only way. You can find out how it should be and sort it appropriately. Good luck with Capital One.
I had a catalogue of errors on my account with Capital One, including my address being changed and information sent to that address without my knowledge. They offered me £10 for the error. Naturally I said no and closed the account, or so I thought...its a long story anyway. Basically I found them incompetant.

Hi All
Just an update really, have called the Ombudsman today and their advice was to take it further so have just filled in my paperwork and will send to them tonight.
They have suggested writing to Capital One for the final time, trying to get it resolved, which I have done. I have faxed a copy to them also and within minutes received a call from Darren Baxter, a manager, saying I was being unreasonable and that people make mistakes. I have requested all communication from him in writing in future and have asked him not to call.
Guess its now a waiting game for his response!0
