Halifax V Hulme

Hi Guys

I'll try to keep this short and hope someone can help.

May 2007 applied to court for judgement on £1250 bank charges
July 2007 Judgement granted
Aug 2007 Warrant of execution granted
September 2007 Stay put on Judgement

Thus account now in dispute ???

JUNE 2007 upped my overdraft to £1250 , when I was granted a warrant of execution I withdrew the full £1250.

Thus account still shows £1250 and is still in dispute. No defaults are yet to appear on my credit file from experian or equifax .

Rang Halifax today following the decision by the OFT etc etc to settle the account in full (dont want any defaults) and except defeat.

They couldnt find my account and redirected me to Blair Oliver & scott??

He wants the full amount ??? how can they transfers this debt when its in dispute?? anyway Ive just gone back and checked my credit file and experian are now showing the account settled paid in full?? will equifax have to follow suit or can you have conflicting information for the same account on two different credit ageancy's

Im not going to pay Blair Oliver & scott if I can get the equifax one marked as settled through the back door (so to speak)

    Blair, Oliver & Scott.

    Bank of Scotland.

    Halifax Bank of Scotland plc.

It's an in-house debt collection name. Makes things sound like they've gone to the "next level", when in actual fact no debt has been sold on.

Can't be much more help than that I'm afraid, although someone else should be along soon enough.
Anything I post is my opinion, so from time to time I may be wrong. I try to provide answers based in fact, however I don't know everything, so (like all posters on MSE), take what I say with a pinch of salt.
  • Tell Blair Oliver Scott that the debt currently is still disputed since there is a court claim still on hold for the bank charges. If they say there isn't then tell them that you have received no correspondence from the Court so you will not pay them a penny.
I have not worked for NatWest Bank since February 2009

  • All accounts dealt with by Blair Oliver & Scott will show as defaulted on HBOS systems.
