They are always awkward about token payments. Similarly, they are also much the same about accepting a DMP.

I too have been having problems with MBNA esp their Indian !!!!! Department. The Irish leprechaun Hit Squad arnt much better either, they just wont listen. If your agreement was taken out before 2007 challenge the validity of the CCA its all on the above thread. There is some great info from never in Doubt and Fermi there.

I too have had big problems with MBNA, they own 2 of our debts - Virgin and Alliance. They have been ringing up about 10 times a dat mainly in afternoon and evening, on both mobile number and house phone. It appears to be the same person who is very pushy and quite aggressive in manner. Lat night he tried bullied my son into getting his dad to who was dealing with a sick baby to come to the phone. I got on the phone to explain the situation and he was demanding to know when husband would be free - I put the phone down I was so angry. He rang back 30 mins later and done the same proceddure with my other son and continued to call on the home line and mobile until 8pm when i assumed he went home.
I have sent a recorded letter to MBNA last week to tell them to only contact me via letter but not sure if they are ignoring this or haven't received the letter yet. It is very annoying and upsetting and the fact that they are so rude and aggressive to my children is outr of order. I wish you luck with getting this sorted.0 -

I know how you feel I was getting several calls a day from MBNA starting from 8.30 am till 9 pm from their Indian Call Centre. If they ring again quote this to them -
I am of the view that your continued harassment of me by telephone puts you in breach of Section 40 of the Administration of Justice Act 1970, and the Protection from Harassment Act 1997.If you continue to harass me by telephone, you will also be in breach of the Communications Act (2003) s.127 and I will report you to OFCOM, Trading Standards and The Office of Fair Trading, meaning that you will be liable to a substantial fine.
Be advised that any further telephone calls from your company may be recorded and used in evidence and I expect this harassment to cease immediately.

Thanks very much for the advice and letter template, I will certainly quote that to them. The person who keeps ringing appears to be from a UK call centre not had any calls from India - yet. I have been avoiding speaking to them, as I end up getting either really upset or angry and it ruins my day/night. I will now though read this to them and hopefully it will give them the boot!.
