Can i get a refund?

In September i got a Tommee tippee steam steriliser from Mothercare..i had my Baby 6 days ago and have used the steriliser for the 5 days i have been out of hospital and its become faulty already. The tray that you put the teats etc on has warped and no longer fits flush onto the top and slants at the back, my feeling are if its this warped after 5 days use its only going to get worse.
When i got home from hospital it had been removed from the box and the box had been put out in the skip and i have no receipt, i do have a print out of my card statement that shows when we got it..so my questions are..
1) Can i take it back with the print out as proof of purchase?
2) They no longer have the same model in store, just the newer model which is £40 which is £10 dearer than we paid for the one we have now and the one they want £40 for is only £32 in Wilkos..so can i ask for a refund as dont fanct spending extra money that i havent budgeted for so would rather get it from Wilkos and save the £8 as every little helps at the moment
Thanks!

without a reciept i doubt they will refund, the best you can expect is a credit if theyll even do that.

Does the steriliser itself come with a manufacturers guarantee? Just a thought.

You do not need a receipt your card statement should be sufficient. You can certainly ask for a refund but it is their choice whether to give you one or not and I would say it is pretty unlikely.

Since these goods are not fit for purpose then you should be offered a replacement. You don't NEED a receipt but the statement will show a purchase from that store, and that should be sufficient. If they no longer have the model in stock you could ask for a refund but are more likely to bbe offered a credit note. If you decide you don't want a credit note stand firm, say 'under the terms of the Sale of Goods Act I am returning this steriliser as it is NOT FIT FOR PURPOSE and I request a refund'

Don't be fobbed off by them claiming that, since you have had it a while you should have brought it back earlier - take a copy of the birth cert to show that you didn't NEED it before then AND most people prepare for the birth of a baby by getting things in early.

OPs contract is with the retailer, not the manufacturer.

having said that it wouldn't hurt to email them and tell them how VERY disappointed she is that such a well established and reputable company should have sold a steriliser that has warped...

  • I've taken a faulty travel cot back to mothercare before, no receipt or anything, just had to demonstrate it was faulty and they exchanged it. It's worth a try, should be ok.

I would say they would probably be entitled to a full refund. It does seem that they've acted within a reasonable time to reject to item.
