This must be post of the year......
You got found out / caught and then try and say you were being honest.
You deserved the sack although I once did a disciplinary for the same thing and gave a final written warning.0 -

My understanding is that if you resign or are dismissed for misconduct you cannot claim JSA for 26 weeks.
However there is no duty AFAIK on your employer to tell the benefits agency why you left employment so if they don't tell them you may be lucky.
What do i tell the the Job Center when they ask me why i got dismissed?0 -

Hmmm....well I'm usually on the side of the employee - but, in your case, I have to say that I do not think its acceptable conduct to claim one has had a work accident unless one actually HAS.
Sorry - but you should not have done that.0 -

You don't seem like someone who would willingly throw sickies now and again, because if you're throwing a sickie, you need to keep it simple. To get an odd day off, a stomach bug (food poisoning) is one of the best excuses as it usually only lasts a day. I'm not suggesting people should throw sickies by the way!
Proceeed with appeal, you have nothing to lose. Offer anything you think may persuade them to give you another chance. Good Luck.
Last year a collegue of mine called me in a panic that the Boss had left her a V/M asking her to call him asap to confirm she was off sick (she was actually on a train on the way to an interview). So I pretended she called in whilst the Boss was away from his desk for a few minutes and left a message on his desk. He looked very pi55ed off that he'd missed her call!0 -
unclekevin wrote: »Thanks for the info, i sort of knew i would be getting dismissed so it wasn't a big shock when it happened, i'm hoping i can somehow win my appeal. In a weird way it might be a good thing as i was thinking of changing jobs, but as my friend pointed out it's always better to look for a job when you've got one.
Although nothing sharpens the job-seeking mind like not having a job in a way. When I left a job before (could not take another minute of the place and would have rather been unemployed) I had nothing to go to so really buckled down and pursued a new job like billy-o. And yeah, "sickies" do really need to be simple. Not that I advocate it of course, but if anyone can hand on heart say they have not had a single duvet day etc then you are a better person than I, and I salute you
If I was the employer, I don't think I'd have gone for anything as harsh as the sack (the biggest softie of them all then:D!!), more a verbal or written warning. I sit on the fence with this issue; I don't take the pi$$, but then I'm of the opinion that it's only one life, so you'd better live it. When you're old and grey, will you look back and regret you didn't share in a trip with your friends and all the memories it holds, or will you regret you didn't go into work for the day?
Best of luck with the new jobhunt thoughDo good deeds and you could raise the curtain, do good deeds and you could really raise your life....0 -
"What if I am dismissed through my own misconduct?
If you are dismissed from your job your employer will be asked the reasons. You will be able to comment on what they say.
Jobcentre Plus will decide whether you have lost your employment because of your own actions.
If it is decided that you lost your employment because of your own actions, you may lose your entitlement to Jobseeker’s Allowance for up to 26 weeks.
If your Jobseeker’s Allowance is stopped you may be able to claim a hardship payment (we explain this later in this leaflet)."

Lay your case out when trying to claim and show remorse for your actions and you may get treated less judgementally than here.
To those of you who prefer to pass judgement rather than actually answer the OP's question, shame on you. OP wasn't looking for moral opinion of whether he/she will get through the damn Pearly Gates or not...jeez.0 -
To the OP, I don't know whether this would work, but if the paperwork for the dismissal has not yet gone through, you could (bearing in mind you have worked for them for 12 years and presumably had no other problems in that time), ask that you be allowed to resign and be given a good reference rather than be dismissed. This would not change the JSA issue, but might help with finding future employment.
