İs child tax credit decision correct?

İ applied for and was awarded ctc but they wouldnt pay because my wife who is foreign didnt have a Nİ number-i am the sole provider and she has no redress to any benefits or funds here in the uk-she cant even work!-any ideas??

I'm not really sure what you're asking? If your wife has no recourse to public funds, then there really is nothing she can claim. We had the same problem when my husband first moved here, and the child was not even his. We had to get him a NI number even though he was not working at the time. I think we had to go to the job centre to register for it - it was a while ago so can't remember.
basically though, even if she is not working and has no recourse to public funds, you still need to put her onto the claim form, even if she has no income. Your tax credits should remain the same.

You just apply for a NI number. I have a friend on spousal visa who has just got his ? You need NI number to work so even though there is no benefits you still get one and then ctc can be paid. SimpleI must not fear. Fear is the mind-killer.

the last time i tried to get a ni number for her we were pushed between piilar and post-because she is not looking for work the job centre sent me to the tax office and they fobbed me off--my wife comes and goes on a visitors visa -our daughter stays here-can you get a spousal visa and not be 'lodged here--mfw'11 No68- 55k mortgage İO--little to nothing saved! i must do better.0

Apologies – I think I misread your first post. I didn't realise that you hadn't actually received the CTC.
I'm not sure who you've contacted so far about an NI number. Direct Gov advises you to call JCP's NI Allocation Service Helpline on 0845 600 0643. They will be able to arrange an interview for you.
Interestingly it would seem that your wife should actually have been interviewed for an NI number as part of your claim for Tax Credits. The Direct Gov website (link below) says: "If you need to claim benefit and/or tax credit (or if your partner needs to claim benefit/tax credit for you) your application for an NI number will be done as part of the benefit claim process".

i was just given a blank no and in view of the afforementioned difficulties of the situation i gave up-that was 2 years ago---i am not sure without further visa applications that she will pass the procedure due to her lack status--i have often flouted with the thoughts of just going in as a single parent status as my wife has no status and doesnt live here permanmently-our matrimonial status the last time i checked wasnt logged here -i paid the fees and did the bands here but it is a no show--guess i shall soldier on paying my taxes and not receiving my dues!!mfw'11 No68- 55k mortgage İO--little to nothing saved! i must do better.0

In your position I would contact the Tax Credits helpline on 0845 300 3900 and quote the information on Direct Gov's website – as part of your application, they should have arranged an interview for an NI number for your wife.
From recollection, the interview for an NI number is really quite a simple procedure. You get given a time and date on which to attend, you bring along as many forms of ID* as possible – I think they take copies of some of these. You then get asked a few questions. My interview was over quite quickly however it should be noted that I am a British citizen – I was born here but brought up in Ireland hence I was not issued with an NI number on my 16th birthday. I am not sure whether the interview differs for foreign nationals.
*Direct Gov suggests any of the following: a valid passport (UK or foreign), a national identity card (UK or foreign), a residence permit/card, a full birth certificate, an adoption certificate, a full marriage certificate or a civil partnership certificate, a driving licence (UK or foreign).

From reading the immigration forums, your wife should be on a spousal visa. A visitors visa does not give her the right to work here or have entitlement to the NHS (except for emergency) and when she "comes and goes" she could be refused entry by UK immigration if they think she is using a visitors visa to reside in the UK. Any reason why you haven't applied for a spousal visa when she is on one of her trips back to her homeland?
You might get more help about her correct visa and how to apply for it, on one of the many immigration forums. They will also tell you that your wife needs to be on your claim for CTC as she lives with you and your daughter. For your wife's sake, your really need to get her on the correct visa.

If your wife is american, you use this site http://www.uk-yankee.com/RENTING? Have you checked to see that your landlord has permission from their mortgage lender to rent the property? If not, you could be thrown out with very little notice.
