Internet Purchase Disputed Delivery, how do I get my money back?

I purchased a small electrical but costly £150 item from a well known online electrical site begining with (D) using my Visa Debit Card. I have waited and to my horror the couriers online tracking details state the item was delivered and signed for, but this is simply not true! I have informed both the electrical company and courier and they say they will investigate my claim but it's unclear as to how long I should be prepared to wait before seeking legal advice through the small claims courts in order to obtain my money back.
I there anything my building society can do to help me get my money back as I paid using a Visa Debit Card?

With a debit card you don't get the statutory protection you get with a credit card. However, I think I'm right in saying that Visa debit cards have a scheme that offers some protection. Ask them.

Also, write immediately to the retailer (don't 'phone or email) by recorded delivery, insisting that they produce a copy of your signature, and telling them that they have fourteen days to cough up or send a replacement or you'll see them in court.

It's no good them saying that the delivery was signed for, they've gotta prove it.

  • Thanks for the quick reply!

I followed your advice and I have typed out a letter to them (un-signed of course) and sent it recorded and they recieved it today according to Royal Mail. I addressed it to one of the customer service managers and now I await her reply. I have searched other related complaints regarding this company and from what I have read it doesn't sound as though they will respond, so if that's the case then my next step will be to go through the small claims courts. If, I'm hoping it won't, but if it does then my fee of £25 to take them to court, well can that be claimed back from Dixons?
I would be grateful of any help you can give me!

In the event you make a claim on Money Claim Online (Small Claims Court) the court fee is automatically added to the amount you claim.
  • I believe you can also add on interest (at a rate specified on the moneyclaim.gov website) and certain other costs you may incur.
