Refund on ear rings

Hi there

The missus just purchased these of Vivienne Westwood site and it's a pair of ear rings:

Basically it is NO Way 2cm x 1.8cm in dimensions.

Its more like 1.4cm * 1cm

We expected it to be much bigger. There online store refund policy
says no returns on ear ring (which is OK) but NOT ok when it's been
falsely described.

I guess am asking what advice you can give when we call up tommorow?
The missus has accepted the loss but me...NO WAY :mad:

Any advice is appreciated. Surely they can't keep our money when it's
been falsely advertised? It's convienient that its out of stock aswell.

    Maybe im wrong but i dont think you can return them due to health and safety issues eg your OH could have an affection and tried them on and decided they werent suitable and returned them and then the infection is passed onto something else. I could be wrong as i said ad if i am i apologise

    and i quote from here "PLEASE NOTE that we no longer accept returns on earrings due to hygiene reasons. This does not effect your statutory rights"
  • I think under the trades descriptions act (or something like that!) you can claim if the item is falsely described or the item bought is different to what is described

    Your statutory rights is to have goods "as described", they are legally obligated to offer a remedy. Either Refund or replacement at your discretion, as it is within a reasonable time to "reject" the goods under the sale of goods act 1979. Your goods do not conform to contract (if what you say is true).

    The hygiene stuff is indeed down to infections etc but it does not overrule statute;)
    Back by no demand whatsoever.

    So size doesn't matter to your wife?...but you are the one that has a problem with it? Maybe she's used to smaller?
