Faulty TV wasn't repaired within warranty period

I originally put this post on a different board, so sorry if anyone is reading it twice.
I've got a problem with my tv. Just over a year ago I bought a sharp aquos 32" lcd from comet. Within the 12 month warranty period it developed a fault in that it takes ages to turn on when cold (about 5 min) and sometimes fails altogether.
I called up just within the warranty period and they arranged for an engineer to come out. He tried updating the firmware in the hope that it would fix the problem, but nothing has changed. Unfortunately the warranty has now expired and even though the problem was not corrected by the engineer I have been told that I have to pay a call out fee.
This seems unfair to me, and I was wondering if they are legally entitled to charge this?
I have tried looking on the terms and conditions but can't find anthing that seems to apply to my situation (although, fyi, I did see that they charge a restocking fee for returned items, and I'm pretty sure that is illegal...).
Any help would be appreciated!
