Capital One problem with Charge request

Need some advice on how to deal with a situation really

Wrote to Capital One requesting that they send me the charges. They have cashed in the cheque and received a letter today saying that the signature doesn't match their records therefore won't give me any information until they have a document with my signature on it. How can this be that they cash my cheque yet send out this letter, surely thats wrong and not in compliance with the letter I wrote to them?

Should I just be nice and send them the documents, or kick up a fuss about taking money and not giving up the goods???

    Many companies will bank any and all cheques as soon as they are received, no matter what the circumstances, for their own security.

    You then need to decide what is more important to you.
    If you still want the details originally requested, you will need to provide the company with reasonable proof you are who you claim to be.

  • Well i'm writing back with a moan but also with a copy of my licence which also has my "old" signature. Yet its the only "documentation" I have with a signature.

    I would write back and say that as your letter has the same signature as the cheque. How do they deem the letter unsuitable but the cheque fine. I would also state that as they are aware of this by their own admission and refuse to your request then cashing the cheque is a clear attempt of fraud as they have again taken money off you unlawfully and unless you recieve your request or a full refund you will be tasking it further.
    State that your address is enough detail as that is the existing address they send all correspondance to. They can even phone you and do a security check so they know they are speaking to the right person.
