Right hi everone here's the story my girlfriend had a bank account
with Natwest wher she had an overdraft which accumlated lots of
charges she took a loan off Natwest with ppi and a nice 24.1% apr
to pay the overdraft.
She started a claim Natwest only give her 3 years statments and they
added upto £6000 they offered £6000 a few years ago but the solicitor at the
time said not to accept because 10 years wud be £10k +
After the court defeat she applied for fianicial hardship and got it and they
have offered her £4000 now she still owes £3000 because of the loan, ppi, intrest
Now here's were we don't know wot to do accept or can you refuse
and they come back with another offer or is it a case get what you given
after she has paid the loan which is what they are saying she will have to do
she's still gunna be in hardship
any advice or pointers would be great thanks

They are highly unlikely to come back with another offer however, if a solicitor has dealt with the claim on a no win no fee basis then what we say is irrelevant since the solicitor is instructed by you to offer advice so you need to ask the question to them.0

We haven't told the solicitor we have been accepted for hardship
in case he wants a cut that was why we didn't accept the £6k orignally
offered cos he said he would want two grand of it0 -
If you are planning to continue with the services of the solicitor, I would suggest you keep that solicitor advised of all material facts relating to the case in order for them to continue acting in your best interests."Now to trolling as a concept. .... Personally, I've always found it a little sad that people choose to spend such a large proportion of their lives in this way but they do, and we have to deal with it." - MSE Forum Manager 6th July 20100

Hello and welcome.
Sorry, but I am a bit unclear from your post so please bear with me.
It seems there are 2 issues- bank charges and PPI. If so, they are separate issues and should be treated as such.
What is the total amount of bank charges your solicitor tried to reclaim?
Who started the claim- your girlfriend or the solicitor?
Who got the issue of hardship accepted by the bank- was it the solicitor or your girlfriend? When was the offer made by Lloyds?
Re PPI
I take it you are claiming this was mis sold- why, on what grounds?
Who is handling this claim?
How much was the PPI, was it front loaded, how much is the interest?
Is there an offer to repay this from Lloyds??
Finally, re use of solicitor. I would have thought you would have been tied into a contract with your solicitor. This needs to be very carefully handled as the last thing you need is a claim from the solicitor. Take heed of the other posts which mention this aspect.
Thanks. Please ignore those people who post on this forum who deliberately try to misinform you. Don't be bullied by them, don't be blamed by them. You know who I mean.
You come here for advice, help and support- thats what I and like minded others will try to do.0 -
Hi thanks for the input the ppi claim hasn't even started yet
the claim was started by the solicitor but the bank wouldn't
give 6 years statments but 3 years amounted to £6000 and I think
he was claiming in the region of £10,000 plus intrest.
When the banks won at court the solicitor said the only way to
go was hardship but my girlfriend filled all the forms and claimed
for it herself surely we wouldn't have to pay the solicitor out of the
offer as he was no win no fee?
The loan I would have to wait till I got home to see amounts but
the ppi was £600 ish with 24.1% apr which we are going to try and
claim for as well
cheers0
