Hi Everyone
I am new to this website and really could do with some up to date help on some financial issues I have.
I have been fairly considerable debt for some time (17K) and with my debts I currently have quite a large deficit on my income vs expenditure. I have spent the last week researching and looking at possible avenues to persue, but I have become confused ! There is so much onformation on the internet and some of it contradicts and not all of it appears up to date in law cases etc.
1) I have a Sainsburys credit card which I have held for near on five years. I have been paying the absolute minimum each month for years and subsequently the debt is not reducing. They recently increased my APR and I attempted to contact them quoting the new government guidelines on apr hiking, they said that they wrote to me at and advised me at the time and being that this was before these codes of conduct were introduced they have done nothing wrong. I asked them to produce my CCA. They responded basically saying that they were unable to provide this but that what they were sending was a 'copy' It doesn't have a signature or date on it and could frankly have been reproduced to respond to the letter. My question is whether this debt is unenforceable ? I know there has been recent press reagrding the credit cards having victory without producing this ? SHould I now obtain a full SAR to further confirm this point ? Or is the fact that the CCA abscent enough to stop payment and let them try and enforce it ?
Any help or a template to assist me further would be really appreciated.
