Black Horse Question

I had contacted the FOS in regard to claiming back PPI from Black Horse but this was in 2002 and as FOS stated in their letter Black Horse were not covered by them at that point, but they may be able to help if I can find out who the underwriter was. I wrote to Black Horse last year but have had no response. I have also checked my agreement but can't find this info. This may be a long shot but does anyone know who the underwriter would be?

    Glad the FOS have confirmed this because many of us have gone this direction with the insurer/underwriter.

    I would contact BH direct, you have the rights to know, ask that they give you the contact details of the actual insurer/underwriter, if not then I'm sure someone on here will know them.;)

  • In 2002, most insurers were voluntarily covered by FOS but Black Horse, as an intermediary would not have been.

    However, if Black Horse subscribed to the General Insurance Standards Council's code of conduct then it would have been covered by its arbitration scheme.

    The GISC became defunct in January 2005 when general insurance came under statutory regulation and so its arbitration scheme was wound up.

    However, in your case, I think Black Horse would have gone from one to the other - so it would have been under GISC jurisdiction one day and FSA regulation the next. This would mean that the complaint would fall under FOS jurisdiction.

    The only problem I see is that FSA rules mean you have to complain within six years of taking the policy out or, if later, within three years of becoming aware of cause for complaint.

    It is clearly more than seven years since 2002 ended so Black Horse is likely to time bar your complaint. Nevertheless, the Financial Ombudsman Service is entitled to waive the limit if it believes there are exceptional circumstances so you could still try.
  • BH's underwriter was Lloyds TSB. I have a claim in from around then which is currently with FOS awaiting an adjudicator.
