    You have might misunderstood me. I don't want be vindicative. I just want to give this person a kind of lessons. This person tried to make my life difficult without doing anything. I cant explain here the reasons as I dont want this person in case looking in this website any connection. But believe me it is very hard to cope sometimes.
    There differents things which this person has made my life misereable.
    Anyway.
    I am sure the flat is not insured as last time we have talked about it and this person is sure that I do pay for the all building and as I know how is, wouldn't even be bothered to double check.
    G M I will have look on the website, thank you very much for your help.
    Anyway Fire Fox thank you for taking time to reply to me. Tomorrow I will give a call to the LVT.

    Teaching them a lesson IS being vindictive in my book. I'm truly sorry that this person has caused you stress, but go through the proper channels. There are many agencies that will support you: the police, Environmental Health, your family doctor ... Please read the LEASE website thoroughly before you telephone them, they are a free service and very busy.

  • If there is an obligation on the freeholder to insure then you should arrange the insurance of the whole building and request the other lessee pays his share of the cost. As has been suggested, if you ascertain that his leasehold title has a mortgage on it you can request the lender to pay up.

    This thread illustrates that whilst in general terms "shared freehold" is a "good thing" in that you don't have to contend with outside shark landlords, particularly with small house conversion set-ups, you are dealing with another person or maybe two or three others and their personalities and attitudes can be quite important in practice, so sometimes, particularly if you can find out their general attitude before you buy, the situations are best avoided.

    It is not a lot of help asking later "Where do I stand legally?" if the answer is that you may well be able to sue the people in question but it will cost a lot of money and cause no end of stress and hassle.

    OP hasn't made it clear how evident the attitude of the other lessee was when he first bought, and maybe there were no warning signs. I would always advise people buying flats in converted shared freehold houses to talk to all the other lessees/freeholders before buying to try to gauge how reasonable or otherwise they are likely to be..

    thank you for your reply. I am very impress how professional is your thread. Thank you again.
    My story is quite long but try to be short.
    I have never bought anything house or flat before, it was my first whole experience.
    When I bought the place, the other co freeholder wasn't the same person. At that time the solicitor asked me to have a joint insurance as a requirement. The other owner (the previous one) assured that he would pay the insurance.But things were not like that. I fought to get my money back for a year after the first year I bought. I blame my solicitor for this because I set up an insurance but struggle to get the money from the other co freeholder. Then after the payment didn't get anything, until he sold the place to this person.
    I didn't want to sign the papers until I was not getting the money back. My solicitor said it's ok, we will fight, dont worry.
    After a while I received a letter from the other side solicitor, said that mine pull out and I suppose to sign by a certain time or I was sued. How nice solicitor I had.
    So the new co freeholder came, we discussed the insurance, I told that I already had an insurance in place. I asked the money but never wanted to give to me. Also he insisted to start to pay when I was renewing the insurance. So since 2008 for one year at least didn't get any money. Then I decided to ask permission my mortgage company to pay only my part and insured my flat. So you already know.
    This person is the most wicked and dogdy I ever met in my entire life.
