sorry for not replying to you.

Right saga continues.....We cnahged the scart lead [after ringing them to come out] and the tv seemed fine....the guy came out and can see the picture was fine and suggested we get the scart lead with covering [as it should avoid interference] but if it happens again ring them and tell them what he suggested and that its the same problem.

So it did all weekend and they came out again tuesday he saw for himself the fault and said it was the tv so they are doign the insurance bit to get a replacement sorted.

They[Very] rang this morning to say they have had their note from maintenance and ringing to request a pickup asked if i had another tv to watch until new replacement i said no as i had given it away so they are ordering me one and once it turns up i need to ring them to collect faulty one.

    Here is the grrr bit.
The tv i ordered is out of stock so i need to order another, i order a similar one but its £30 more, she says i will have to pay it....she orderes it and i also ask her if i can have the same discount & other code as before yes so she applied it.

I get the order confirmation and on it they are charging me delivery  and the code they used is the same code but for a different amount.....10% instead of 20% soi ring up and they say i need to be put through to that woman and she will ring me back.....few hours later still no phonecall so i ring them and this gus answers and basically arguing with me to say no 20% is for books i said look at my account and add up the cost of the t.v the the discoutn given ...its 20%...went silent and cant give me an answer  will need to ring me back tomorrow as their phones in that department are down.

SOam I right to think as the fault is with the tv and not me,and that particular one is out of stock i got the nearest one with a difference of £30, i should get the tv with the same discounts at the same price i odrered??? with the £30 taken off too??

Sorry this is a really long one.:o

The short answer is no. You CAN reject the TV and have a refund of what you paid, but if seeking an alternate resolution the retailer can choose the most economically viable option for THEM, as long as you do not end up out of pocket. As you have asked for a replacement, they would arguably be within their rights to ask you to pay the difference in price between the old and new sets. You technically have no right to the discounts if they are not currently in force either.

That said, you should not have to pay delivery for a replacement item if claimed under SoGA.
  • hi thanks for replying.....well they will now not give the discount i had on the tv i have for the new tv.

So we aregoing to get them to collect and cancel order....and go elsewhere.
