does anyone know how far we are from new template letters being available/ i thought i heard january are they still on course for this month?

    I would wait until Martin & his legal expert publishes his own template letters (which hopefully should be this week unless they are delayed again).
    Q. How likely is it I will get my money back?

    A. Much less likely than prior to the result, but not impossible. Still, the best thing to do is plan for getting nothing, but cross your fingers.

    As we know many people would like a 'what's the chance' type answer, our instinctive guess is even with the new argument there is only a 10-20% chance of most people now getting charges back.

  • I was waiting for Martins template letters and have read the other replies about the govern website. However my bank has now contacted me about my claim stating they will not be refunding any money and if I do not reply within 8 weeks they will consider my complaint closed. As I would like to keep my options open over claiming in the future how should I reply to this letter.

    MLT, the current situation is that we are effectively starting again on the bank charges campaign. The Supreme Court effectively reset the bank charges campaign. There was a time when the advice was "you have no chance" and now Martin suggests 10-20% but prepare for nothing. The reason is that newer arguments have not been tested in the courts. They are being used today and at the moment until we know how the banks will defend the action will depend on how things move forward. At the moment, expect nothing but remember if you do decide to go forwards then you have to be prepared to work hard and not simply write your name and address and amount on the form and assume that you will be repaid. It will be about YOU the individual and how the charges affected YOU the individual.
    Stay positive and we will see what the next few weeks bring with regards to actual court defences.

    For a few days whilst Martin was initially shocked at the decision of the Supreme Court on 25 November, and didn't know what to advise until he had time to consider the future (in conjuction with legal experts) he may have said 'you have no chance' but I don't recall that. :confused:

    Prior to the court decision the message was reclaim, reclaim, reclaim; the charges were unlawful, illegal and/or unenforcible.

    Since 02 December (possibly earlier), following requests to put a figure on the chance of getting charges back it has been:

    "only a 10-20% chance of most people now getting charges back.",

    but the basic message has remained from 25 November i.e.

    "it's likely to be thrown out if your argument was based on the premise of the OFT's original case"

    and, even with new legal arguments,

    "the best thing to do is plan for getting nothing, but cross your fingers."
