Summons help

Hey I don't know if this is the correct place to post this thread. My friend was asking me the other day about some advice about how a summons works, There is a train company trying to serve a summons on him for being drunk, But so far he has avoided it, He told me they tried to send out a recorded delivery summons by the royal mail but he never signed for it, Does anyone know what happens next so I can pass the info on to him as even though he isn't to worried he id annoyed that they can't get the message that he doesn't want to attend,

I asked him why he won't go but he said that the train conducters made up a pile of lies to get him in more trouble with things like threats to kill and racial abuse though i know myself he is not that type of fella even when he has been drinking. He feels it's clear who the court will believe, a big company or else 1 person, That is why he feels he can't attend and will try and avoid it at all costs. Thanks for any advice :-)

    Simple advice. He can't get out of it. Unless he leaves the country under a false passport, I suppose.

    And in all my time travelling on the railways, I've never seen anyone 'picked on' by the ticket inspectors, only ever aggressive, defensive or downright threatening people caught without tickets or stinking drunks making a nuisance of themselves.

    If you include drunkenness along with threats to kill and racist abuse, I'm thinking you have the classic case of a practically paralytic drunk making an idiot of themself and trying to get out of it now.

  • What is the next stage after they have tried to serve the summons by recorded delivery? I pursume they have tried to serve him by the summons guy, I have heard in the past that you can just keep avoiding them, As he hasn't been charged with anything by the police and therefor it's just a private matter. I doubt very much he would need to leave by a false passport as i say again he wasn't charged with anything by the police :)

    court employee: nope

    magistrate: guilty. Next!

  • Yeah but you need to be served before the judge can find anyone guilty ;) It would be different if he had been served him summons and not turned up, so they def can not find someone guilty without them being served.

  • Send the police round?
  • What is he doing wearing a disguise every time he leaves the house?

    He's been on the pop too often if he thinks they won't serve it.
    It's taken me years of experience to get this cynical

    Royal mail don't *always* get a signature - they should but weve had recorded deliveries through the letterbox before
