Alrighty guys
Just looking for a bit of advice here...I purchased an iphone from top seller on ebay. He had 100% and a history of selling iphones. My problem is not with the iphone because its perfect but its warranty. Heres my story...
I purchased an iphone for my girlfriends xmas on 21st december and it arrived on xmas eve. Now my girlfriend has been travelling and was due back on the 9th jan so we were going to have a late xmas. Now i turned the iphone on and checked the phone etc and everything was fine so i left postive feedback. I then turned the phone off and put it back in the box to wrap up. Girlfriend arrives back some 2 weeks after i purchased it, opens the iphone and likes it, perfect i thought. However when i hooked it up to itunes to put songs on it i also went to the apple website to activivate my warranty and it said it had already been activated on the 2nd December which was 3 weeks or so before i bought it.
Now the seller had advertised this as an "unregistered brand new iphone" and is one of the main reasons why i chose to buy from the seller. I could wait until the middle of january to activate the warranty so i wasnt going to be missing out on a month or so of the warrany when it was simply sitting unused under the tree.
I have emailed the seller and he has appoligiesed etc so i sent an email back on thursday asking what his returns policy was and as of today (18/01/10) he has not got back to me.
any advice or similar experiences would be great.

You have 45 days after purchase to open a dispute.
I would open a not as described dispute now, he can reply using the PayPal dispute.
He may try and string you along until the 45 days are up.
you have solid evidence that the phone was not new when you received it (as warranty was already activated)0 -

Feedback is not taken into consideration in a dispute.
Have you tried to phone the seller? You can often sort things out better by speaking to someone personally.
Use advance search and find contact details. You'll get their phone number and they will also get yours.
If you get nowhere with this, you have 45 days to open a dispute - wait until your asked to return the phone and do so by trackable means - Special Delivery due to the value would be essential.0
