RTA - 3rd party insurance, solictors dropping my case

    but in the eyes of the litigation perhaps its looking not good.

    Im fully aware that it is not a target and at no point did i exceed that limit on the road. I'm just a bit surprised that the concensus is that I am at fault in this matter, Nowhere in my lessons or in the highway code does it really mention blind summits and having dropped down 15mph felt I was actually following the code and adhering to safe driving. The road was clear in front of me my whole journey I obviously had ruled out the fact anything would be in my side of the road so close to going over the apex.

    You came upon an obstacle and by your own admittance couldnt stop in time. Because you were going too fast for the conditions.

    Then, I would politely suggest that you take some driving lessons.


    You were at fault, face facts, you could not stop in time.

    Had the car in your path have been a fallen tree, you would still have collided with it.

    Think of it another way, if a car had broken down on your side of the road where the crash occured and a car was travelling in the opposite direction so you couldnt move over to avoid the broken down car, could you have avoided a crash?

    OP you have discovered that there is always a "risk" at driving at any speed. Very few of us would be driving at 15mph (and we would be in exactly the same boat as yourself) and it sounds as if you have been unlucky but at the end of the day you were indeed going too fast for the conditions.

    Ju7st need to chalk it up to experience a move on.

    Also with all the recent ice 5mph might have been too fast.

    !!!!!! happens I'm afraid.

    Hintza, thanks for this post.. one of the only ones who hasn't had a go at me - im not a bad driver and my wife was in such a bad crash a few years back I wouldn't dream of driving recklessly. Sucks but I guess thats life

    I don't think anybody was " having a go " at you, they were just telling you the hard truth about the matter.

    You are a bad driver if you drive too fast for the prevailing conditions, I'm afraid.

    Never drive faster than you can see to stop safely, as Hintza says, that may be as low as 5 mph in certain conditions.

    To be fair as i have said I doubt many of us would be driving at 25mph in such circumstances. (But we don't know the road so who knows)

    All that really matters is, I would be driving at a speed at which I could stop if I couldn't see, that may well be less than 25mph, depends on the situation.

    The OP clearly couldn't stop in time, so was obviously going too fast for the prevailing conditions.
