Abbey: Is there anything I can do?

I am kicking myself for not putting in a claim before the latest court case.

I've had an account with Abbey for years but we got into serious debt last year with husband's redundancy. I lived in my overdraft for most of the year and in September CCCS advised me to jump banks quickly. When I switched accounts I was at my overdraft limit of £2100, now with interest/charges it's £2700.

Husband now has some income and I'm increasing my earnings. I have written to Abbey in the last fortnight, and our other creditors offering payments based on what we expect to earn over the next couple of months. (hoping that we can increase payments after that - we need to pay back some mortgage arrears first as a priority).

Looking back, I reckon that at least £1500 of this £2700 is made up of bank charges. (We had a blip a couple of years back when I got into a spiral with bank charges but I recovered).
I think we do qualify as being in financial hardship, but is there any point in me trying to claim? Abbey tells me they won't accept my payment offer and they are passing the matter to a DCA.

    When we first spoke with CCCS our absolute basic outgoings were more than our incoming. We now have (as long as income holds up - we're both self employed so there are no guarantees!), absolute basics excluded, £180 "spare" which we are using to make token payments amongst our creditors. It's only this month we have reached the situation where incoming exceeds outgoing. We haven't yet got enough "spare" for CCCS to put us on a DMP.
    Maybe we are outside financial hardship now, I will double check.
