Bank of Scotland Charges

I have been trying to reclaim bank charges on two Bank of Scotland current accounts I had whilst at university.

I used the initial template letters and sent two seperate cheques asking for the past 6 years on each account. This was around 2-3 years ago.

After numerous telephone calls I have still never received statements for one of the accounts but have receivied three copies of statements for the same account.

I have today received notification from the bank stating they will not refund the charges and have given me eight weeks to reply.

I am extremely unhappy they have taken this course of action as I was charged around £1000.00 in charges for both accounts combined. In addition, they have been chasing me for payment of a now revoked overdraft, which has been passed to debt companies to chase over the past year or two.

Can anyone advise of the best course of action I should take.

Thanks.

  • Hello, I think there will be a new template letter on this site in the next few weks, which you can then download and send. I am in the same position as you with regards to charges and RBS. I went on a website called Govan law centre. There appears to be a template leter on there already. Good Luck!

Have the banks cashed your cheques?

Why have you left it 2-3 years before chasing them up? Didn't the template letters give the banks 40 days (or thereabouts ) to supply what you paid for?

Following the decision of the Supreme court in November 2009, any claim you've made (based on old template letters) is likely to be refused.
Even with the new template letters (which hopefully will be available this week unless it gets delayed again), Martins current suggestion is "even with the new argument there is only a 10-20% chance of most people now getting charges back"
"For money management's sake, its very important to assume you won't get a payout "
"Now to trolling as a concept. .... Personally, I've always found it a little sad that people choose to spend such a large proportion of their lives in this way but they do, and we have to deal with it." - MSE Forum Manager 6th July 2010

Only thing I would add to Premier's post is stay positive as new reclaims guide should be live this week and furthermore newer arguments are currently being tested in court as we speak.
I am interested in the point, Premier made, were both cheques cashed? Why 2 cheques when a SAR request would only require one cheque for both accounts?
I have not worked for NatWest Bank since February 2009
