Can I have some advice please?

I recently split from my husband - 10 weeks ago.

He is staying at his mum's, we have kept things regarding finance as if we have still been together up until now.

The mortgage is in our joint names, the house is up for sale but the market is dead.

Last week he started a new job, so I need to inform tax credits but realistically I am best just letting them know we are no longer together and starting to claim benefits for myself and the kids. We have three children.

I have to find out if they will cover any of the mortgage because my ex cannot afford it on his own when all changes, therefore we could lose it? Does anyone know where I stand on this?

We are officially still married but apart so what am I entitled to??

Am I best seeing a solicitor or the benefits people first?

Thanks!

Mx

  • Hi,
I am in exactly the same position as you Mad Money except it is me and my child who have moved out of the house as it was originally ex's property. I was added to the mortgage a year after he bought it, i would be grateful for any advice as to where i go from here. Ex does not want to sell even though he cannot afford to take mortgage on on his own and i cannot get any help whilst my name is still on his mortgage, i want nowt financial from the house i just want to move on, any advice gratefully received :)

You need to close the joint tax credits claim and claim as a single parent. Are you still living in the house? If so you are both still liable for the mortgage payments. There will be no help with paying the mortgage if you are in employment, same with your partner
