Redundant but received no pay for last month, or redundancy pay

Hi all,

[Apologies for posting this again, but I stuck it in the wrong place last time.]

I was given two weeks redundancy notice on the 11th December '09 and worked until my last day of the 24th.

I'd been there just over two years, so know my redundancy payment is two weeks wages.

To this date, I have seen neither my last month's pay, nor my redundancy [they are citing "cash crisis" and will pay "as soon as possible"].

I have however, received my P45, yet they have not [or have not replied thus far] stated whether it includes my last months pay or not.

What [if anything] can I do? I've almost given up asking when I'll be paid. Should I hit ACAS, a solicitor, Citizen's Advice?

I'm currently seeking employment, collecting JSA and can theoretically survive. I just would like to be paid what I'm due.

Any suggestions as to a sensible course of action would be greatly appreciated.

    If they haven't paid you they are acting illegally as Redundancy pay needs to be paid within 30 days of you leaving. Ask (again) for a breakdown of your final salary. If they can't pay rather than won't pay then you are possibly talking insolvency and creditors - far more complicated.

    If it is a case of won't pay then it will have to be an ET claim. Speak to ACAS first rather than spending money on a Solicitor -although the advice from ACAS can be touch and go as their helpline is basically a Call Centre.
  • I spoke the the Citizen's Advice last Monday [absolutely superb service for something so undervalued by our Gov't] and they recommended I write a letter asking for the full monies on or before the next pay-roll date. Which is the end of this month. It was sent registered post.

    Since then, I have heard they've folded the company [they wouldn't bother telling me this], and as far as my redundancy is concerned, I know the Gov't redundancy lot will pay this if I claim within six months.

    But what now of my outstanding wages for December? Is there anything I can do? They'll just relaunch as a different company - seen them do it before.

    It's so frustrating as they're refusing contact with myself and two others who are in a similar situation. And when they do speak, it's a different story to everyone.

  • im also being made redundabt, just want to confirm, is that
    im working my 4 weeks notice, which finishes on 26th february,
    so do i get my february pay packet and 4 weeks redundancy pay?

    can anyone help?

  • I would suggest you contact the Redundancy Payments Office. Contact a local Law Centre and/or CAB Employment Law Specialist for assistance in completing the form.
  • Surely your P45 won't be correct if it includes monies you have not had?

    I would advise seeing a solicitor, you can get half an hour free advice with most. Sorry for your situation best wishes meg
