Consultation & Interview

I am facing redundancy this week. The department I work in employs two people. I am senior and the other is junior. The company have decided to restructure and as a result have advised one new role will be on offer if we want to attend an interview for it.

Confusingly the 'new' role is exactly the same as the one I currently do and has the exactly the same job description as when I first started the role four years ago. The interview for this role will happen after consultation on the same day.

I thought that consultation was used to decide on which person should be made redundant, in which case why do I have to be interviewed for the 'new' role that I already do? Is this legal?

If the work our department does is no longer required, can it not be argued that our department be closed? The company has said that as a result of restructuring our department will experience diminished workloads. If our work is passed to other employees does this mean making one of us redundant is a sham?

Is it legal for me to record the consultation and interview using my phone?

Any advice is much appreciated.

    Well it isnt really the same job as its obviously going to involve doing more junior work a lot more often - and no doubt this is reflected in the salary.

    Tbh it sounds perfectly legal to me and certainly no sham redundancy. The workloads are less and dont need 2 people.

    Yes the job description may be similar but the proportion of the work wont be.

    Consultation is for those involved to discuss with Management ways of avoiding redundancy.

    You have been offered a competitive interview and from that they will decide the best person for the role.

    Elements of both your jobs have been "matched" to the new role, hence the reason you are both being interviewed.

    I know few Companies that allow recordings. This will only make things worse for you if it is not allowed and could posibly be considered Gross Misconduct meaning you would be out of a job anyway to put it bluntly.

It has also been apparent over the past few months that I was been overlooked, and not included in meetings that I usually would. At the beginning of the week my admin rights to the intranet system stopped working. :(

    This has made me really angry and upset. I did consider appealing but I don't think I want the extra stress it would cause.

    But on a positive note I am happy I'm finally rid of a job that gave me little satisfaction and a had a very stressful working environment.

    Did you raise this lack of involvement over last few months and try to be more proactive or just go along with it?

    challenge your right to the intranet being removed. This appears to be unfair. You' re leaving so you have nothing to lose. Ask for the scores to be made available, you should be entitled to yours and the other persons. If the scores don't seem fair then appeal. If there is anything underhand then it will be them feeling stressed out!

    My situation was/is similar wrt exclusion from meetings etc. Fortunately I have emails recording my disatisfaction - which I may need to use. It's awaful when companies behave in such a way. Being made redundant is a horrible thing to go through and I really don't see why they feel the need to be so unpleasant to you on top of everything else. Enjoy your search for a decent company to work for. If you can get feedback from your interview and make sure you give yourself credit for the things you scored highly on - not focus only on the areas they may have scored you lower - especially if you don't agree with their opinions (which I'm guessing you may not). Best of luck and go out with your head held high.
