ebay seller refuses refund, paypal won't help, ebay can't help

Hi there, and thanks in advance for any input,

I bought a printer on eBay, paid with PayPal using a credit card. Printer had a slightly dodgy USB port (not a biggy, but still a fault), was missing the inks promised in the auction and had the wrong power cable. I can't even get it to power up with a power cable I borrowed from someone else, but it's possible it's a faulty cable.

The seller promised me replacements so I didn't make a fuss with PayPal/eBay, but they haven't arrived. Now he's refusing to refund me at all, and claims PayPal still has his money but PayPal said on the phone they wouldn't withhold it this long. It's possible though that the woman I spoke to on Customer Services at PayPal overlooked the fact that his account may have been frozen, I don't know. The seller is actually being quite rude and hostile to me (didn't even reply to my messages or speak on the telephone until I mentioned county court), but as I understand it that could make my case stronger.

eBay's only suggestion was talking to the Police. PayPal told me to contact eBay (it's been more than 45 days as I was waiting for those replacement parts). I'll try a credit card dispute but as it was under £100 and it went through PayPal I doubt I'll have much luck.

The seller was clearly operating as a business, despite his eBay account being a "personal" one. His PayPal account is registered as a business and he sold 12 printers in two months which is clearly for profit (ie business). I have all sorts of reasons backing up my refund claim including DSR and Sales of Goods Act.

I'd really prefer not to have to go through small claims because it'll be ages before I get my money back, and knowing this seller I'd end up going back again to get a court order for him to pay, so any further ideas would be appreciated. Is there any way I can get PayPal to refund me? Their 45 day limit seems unfair in this case and I'm claiming under my consumer rights not their buyer protection policies.
