Redundancy & working notice period

Hi haven't posted in ages but not sure where I stand with regard to my notice period.
I am under redundancy notice and have been guaranteed work for 6 months. However, I have a 2 year old son to support and therefore I have been looking around to see what vacancies are around to protect my position.
A few agencies I have spoken to have not wanted me on their books due to my notice period which is 3 months and they consider this a problem as unlikely any new employer will hold a vacancy for that long.
I have only been at the company for 6 months and therefore what have I got to lose if I am offered another position by leaving before the end of the 3 months? I have spoken to HR who said that the ultimate decision is made by my line manager who has told me that she will not release me before the end of my notice period but what can they do?
If I give 1 month notice surely this is reasonable given the fact that I have been given redundancy notice?

Have you been given notice and terms?
Are they offering PILON or is the notice to be worked
Remember redundancy notice can be with withdrawn allthough if you have a job offer this is not usualy possible

If you have only worked for them for six months you will not be receiving any redundancy pay.
If you are contractually required to give one months notice then that is the maximum they can force you to give. Why hang around if you have another post to go to? If you have to give 3 months its worth trying to negotiate with your line manager.0 -

Hi thanks for your reply.
My contract says I have to work 3 month's notice. However my new employer is not willing to wait that long. Basically I want to try and compromise with current employer but they are taking a firm line and have said I must work the 3 months as they have too much work and not enough staff.
I was going to offer to work one month and then go once pay in the bank but I don't want to leave under a cloud if at all possible.
I just wonder if they could force me to repay 2 month's earnings under breach of contract if I leave after 1 month.

They won't have paid me for it!
If, say, I hand in my notice on 1st Feb and leave 1st March, in view of the fact I have 3 month's notice will they be able to recover monies for the 2 month's previous pay to make the 3 months? So can they take out December and January pay for example in view of the fact that I will not have worked the 3 months as stated in my employment contract.

Leaving early without agreement is risky since it can be put in references.
Burning bridges is never a good idea you never know who you will meet again throughout your working life.
Also you risk being sued for any damages due to you not being at work as contracted. They cannot take money back without taking legal action. Just make sure you have al monies due especialy any expences and wages.
Do you know anyone looking for work that could do the job and might be interested in short term job, that may help with the negotiations.
You are still in the consultation phase so I would ask why they are so sure they will be too busy for the next 3 months to let you leave early and possibly the 3 months after that as well then not have enough work so need to make you redundant.
The enxt thing is this job has only been 6 months and they are offerng at least another 6 so far, what makes you so sure this time the next employer is going to be any better and keep you on any longer?

I have been told that I am in a redundancy pool and have been told verbally that there is guarantee of work for 6 months plus my 3 month notice period. I have not been given an end date.
I appreciate the risk involved. However, I have now been offered a new job but the new employer won't wait 3 months. The job has very good prospects and I feel lucky to have been even offered anything in view of the market at the moment.
I think I will see how long the new employer will wait and then try and start negotiations with my current employer.

So you have 9 months thats a lot if you believe the business has a chance, how much better is the new prospect, what research have you done? (relative to the current job).
How big is the pool of people.
What is the keep on count from that pool
How do you see yourself in the pecking order
Can you improve this over the next 9 months
Are the company being conservative or is it likely to just be down hill from now on so even if this round is not you the next is.
Its consultation and negotiation time, remind them consultation is to look for ways to avoid redundancies and the impact on the employees and the business who are the reps what are they doing ow were they elected
It is unusual to give 9 months advanced warning without a definate plan unless it is to get people to leave.
Start asking for the 9 month in writing and how sure they are the busines will last needing people that long but not longer
You seem quite busy is there a way to save money now
eg: suggest lay off some supervisors and spread the load to the more capable underlings etc.
Making good ideas will make the bosses review or the supervisor may cover their a***s and let you go early.
Think outside the box as they say, you have nothing to lose if there is no money and you want to leave0
