Need advice on a legal issue concerning a car

My cousin is seperating from her partner. He has upped sticks with her car which she paid for and is registered in her name. He is claiming that he can get a V34 form and pay £25 and change himself to be the registered keeper, and effectively claim her car.

Is this right and legal?
What can be done?

She is seeing a solicitor on Tuesday but time is of the essence.

    Being the " Registered Keeper " does not make that person the legal owner.

  • Personally, I would report it stolen. Would be interesting to see him explain why he is driving a car with no permission, owner docs, insurance etc.


    Also, if he does prang it, any claim may go on YOUR policy..?

    Seconding reporting it stolen. Since he's not a career criminal he wont have changed the numberplates and so next time he drives through an ANPR camera he'll get pulled and questioned.

    Bear in mind though, the police will impound the car and charge you £105 towing fee and £12 per day storage fee, so getting your car back could become expensive. In my experience the storage companies are always operated by shady, miserable, !!!!!!!s who will employ whatever tactics they can to delay you getting your car, so make sure you take muliple forms of payment (including cash), plenty of ID and all the car's documents before you go to collect it.

She can't remember if she transferred the money into the joint account and paid with the visa. Or if he paid with the mastercard and she paid the mastercard for him via the joint account.

    Well she may have difficulty in actually proving ownership under those circumstances.

    Best see a Solicitor.

    Doesn't matter how it was paid for, the car was purchased in her name. She has legal title. Report the car as stolen.

    but to change keepers doesnt the registerd keeper have to sign their name..... so if she didnt sign wouldnt it be illegal anyway? because he would have to forge her signature or something?

    plus if they used his mastercard and she paid him - surely there would be some trace of it somewhere, a bank statement or something

    also, i keep hearing that 'registerd keeper' and 'legal owner' are diffent on here....so if you sign the V5 in your name when you buy it - you are the registerd keeper, how do you become the legal owner then? or is it automatically the person who pays for it?
