broken goods

i bought a fridge freezer 2 years ago, and it has now a broken outer motor. i would normally either get it fixed or buy a new one, but due to redundancy i really cant afford to. i would expect this product to last many more years than 2. am i entitled to go back and ask them to replace it as it hasnt lasted the resonable lenght of time id expect it to?

  • You could ask them to repair it - not sure about a replacement as you would have to prove an inherent fault and you've had 2 years use out of it. Try ringing them to see what they say.
  • Assuming manufacturer's warranty was only for 1 year, you can still go back to seller. You'd be arguing that it is not satisfactory quality under the sale of goods act 1979, as long as it isn't a wear and tear issue or something you have done/contributed to.

    Having had it 2 years, you may have to prove the fault if they ask. Repair would be a reasonable remedy, unless impossible or uneconomical to fix. Also a brand new replacement would prob be seen as unreasonable, so more likely to be a discount off another one (as alternative to replacement) or a partial refund. No exact formula of working out how much it should be, but can think about expected lifespan compared to actual lifespan and work from there. e.g if you expect 5 years and you get 2, you've had 2/5 (40%) of expected use so could ask for 60% money back.

    It also depends on the quality and cost of the goods. From a quick few searches it looks like the average fridge freezer should last about 5 years. So you probably do have a case to argue that the goods should have lasted much longer.

    How much did you pay for it, was it an entry level model, or high end? If it was a cheap one then supplier could argue that it it's unreasonable to expect it to last longer than it has.
