Faulty building work

Six years ago we had big extension works done under a JCT Minor Works contract. Over this winter a problem with a velux window has appeared,. Only spotted this because of damp appearing inside. On comparing this velux with all the others put in at the same time it is apparent that this one wasn't installed correctly by the builders. I'm no expert but I reckon that the frame will have to be replaced.
After this time should the builder replace it? I appreciate the defects liability period has long expired.
Any advice??

if they are a decent builder, I would consider that they should at least contribute towards it...

The fault was in the installation as they didn't install a protect metal cover over the frame in the right place. It has only become apparent after 6 years because that's how long its taken for the wood to rot through from the outside in.
While I hope they will be reasonable I know there has been a change of ownership (but still same company) and I'm not sure that the new guy will be as good as the old - hence trying to establish the legal position.0 -
I guess you need an independent report on the defect. You can then present that to the builder for his comments.
It all depends on how co-operative the builder is.0 -
If you know it was the original work at fault, then you can go back to the original builder armed with the facts.
My first port of call would be the builder - tell them what you've found..see what they say.
They may well offer to replace it and make good...
If they don't, you will need to consider small claims action probably - which will involve you getting an independent report about the original job.
