  • up to my boyfriend moving in dec'08 there were no "changes to report" that hadn't been reported,
    when he did move in I came off all benefits informed every one.
    I am correct, I have to prove it, I am entittled to a representative at a tribunal

    Yep you are definately entitled to a representative and i would always exercise my right to one!

    a statement of fact is only what the LA/DWP submit to the tribunal. You have the right to argue against that - esp if you have the proof! If you don't mind me asking - what date was your Income Support withdrawn? - HB should be taken back to sunday following your IS stopping. What reason was on your HB o/p notification letters?

    Thank you for your replies,it is an appeal tribunal against their decision,the dwp & council, council tax & housing benefit & income support i/s want approx 1200 back (haven't got the file out) LA want council tax & housing benefit back over £20,000 03-07 my boyfriend moved in dec '08
    my income support was reduced as I was in reciept of carers allowance for my son who had behavioural problems.

    Why do they think that he was living with you from 2003-7?

  • Am I right into thinking that they are accusing you of failing to report a Change of Circumstances?

    Claiming whilst not doing that is fraud so allowing you to take it to an Appeal Tribunal clearly shows they have no case for a prosecution. If they really had a case it would have been an Magistrates Court appearance.

    Ah ok - why would HB then withdraw back to 03!!!! Usually HB follows the dates given to them by the DWP!
