can i reclaim some late credit card payment charges?

a little advice needed. i paid two credit card bills slightly late (full payment, not minimum amount, had arrived in halifax' accounts 2 days after due date on both occasions) and was charged £12 for each late payment (£24 in total).

i understand that i have entered into a contract with halifax and that i have breached those terms, however, is it possible to argue that the sums they have charged do not reflect the costs they have incurred?

thanks.

"The argument that the charges exceed the customers losses are not enforceable by law is covered in the Unfair Contract Terms in Consumer Contracts Regulation 19999, Unfair Contract Terms Act 1977 and at Common Law. Some banks argue that these charges are a fee for a service, however if this is the case then they must be reasonable under S.15 of the Supply of Goods and Services Act 1982."

  • Have you tried discussing it with customer services? They can sometimes refund your charges if you ask

£12 is in line with the new commitments that have made on fees/charges - you are unlikely to get any support from ombudsman even if you go to them

If you have understood the contract and signed it you certainly understand that you have to keep your side of the bargain. Many a times one late payment is overlooked and the fees refunded on request. What is is your excuse for paying late twice - you clearly seem to be looking for a way to wriggle out of your commitments by going down this route.

yes its possible to argue that but it is also possible to argue that you paid late twice and knew what the charges were, however unfair you think them. The point is how much do you consider a 'fair' charge. I imagine you want all your money back so that in essence you dont pay for your mistake.

BTW I speak from expereince as i was charged by my credit card company twice but it was my fault and i knew the charges.
  • I got money back from egg but the charges were £16. They agreed to refund the £4 difference plus interest on the £4.
I took it! I'm pretty sure £12 is the "acceptable" charge now.
