What were you reclaiming: PPI on Credit Card
Who was the provider: EGG
Sorry to duplicate this but I really could do with some advice.
I have tried to claim for the misselling of PPI on my credit card with Egg from 2001, they refused so referred it to the FOS. I Received a letter from FOS today not upholding my claim!! To sum it up they say that "it is clear from the evidence from Egg that I was presented with three choices, which were to opt to take the cover for myself, for my partner or to decline cover, which I apparently chose to take out the cover (This would have been a Pre ticked box) The terms and conditions were online which I ticked to say I had read it. They say that although I had pre exhisting conditions it was up to me to check for exclusions. "Furthermore, it is evident that you had to act positively by selecting an option on the application to take out the policy." Cost of the cover was clearly shown on the online application and would have also been on the monthly statements. You commented that you were unaware that you had the policy until Egg sent your statements, however I can not conseder this point as your statements were available to view online (I never checked and I could not as I did not know my log in details)
Hope that makes sense as I have tried to shorten it. I am so dissappointed!
I have since written to FOS telling them I am unhappy with their decision and that at the time of applying I beleive egg used pre ticked boxes which I found very confussing and not a fair. That it was not clear that ppi was optional,. I was in a scheme at work whereby I got full pay if off sick.
Can anyone give me any advice, especially anyone who has won against Egg. Many thanks

Hi there
sorry to hear this.
Your doing the right thing writing to the FOS to ask to reconsider this and ask another adjudicator to take a look at this for you, you also need to make them aware that you did not view online because you were not aware that you could do this.
Are they also aware of the scheme you had at work? if not let them know this and tell them "if you were aware of this then you would have opted not to taken this out, "if given the option, but you cannot recall on the PPI on the sale of purchase, which would be worthless to you anyway if your already protected at work through a protection scheme".
I'm sure they will look into this for you, fingers crossed and hopefully others will come along with some help and opinions for you as well, good luck.;)The one and only "Dizzy Di"
