PPI in hostage

I just received an reclaimed PPI offer from Alliance & Leicester .However instead of giving it back to me ,they have decided to apply it against the outstanding amount of my loan.

I am going through financial hardship due to loss of income and have registered with a debt management agency in July (CCCS).Since then,I have faithfully paid every month towards it.

Can they hold to this refund? I could do with it to sort a few utlity bills.
Let me know what I can do to claim it back.

    Unfortunately, yes they can still do this, and anything remaining should come back to you if any.
    You could always write and tell them you are requesting they refund directly to you, as you have a set plan in place, where if you were not mis sold PPI in the first place then the debt would not have been as high as it is. And you have been deprived of your money.
    Although its not guaranteed they will do this, because it seems this is the way they deal with refunds if arrears etc.

    Unfortunately, if you are in arrears with the loan the lender is likely to utilize any refund due to you to reduce any outstanding debt. If you are not in arrears with the loan it is not acceptable for them to do this.
    I am a former Broker, former IFA and former compliance officer, for my sins.

    However, I have since seen the light.
