They do not refund eBay purchases when paid by PayPal.

Capital One do not want to make a refund for a fraudelent item bought on eBay, because it was paid by PayPal.
What do you think about it?
How can I challenge their decision?
AFAIK other credit card issuers make refunds in such situations.
Which issuers do make refunds in such cases?

This is what they wrote:

[/FONT]As a credit card issuer, our influence over a merchant in a matter of this nature is limited. We are not in a position to contact the merchant directly and are only able to deal with their processing bank in order to resolve a dispute on one of our cardholder's accounts.[FONT=&quot]

[/FONT]Under usual circumstances, we are able to approach the merchant's bank for a refund when we are disputing a transaction. However, in this instance, the agreement that we are involved with only includes ourselves Paypal*Ebay Sales and you. Therefore, as Paypal*Ebay Sales their part of the agreement by providing the service of arranging the payment and are still trading, we have no grounds to approach their bank for a refund. We are also unable to approach the bank of ***** as this merchant is not a party in the agreement we are involved with.[FONT=&quot]

[/FONT]Therefore, I must respectfully suggest that you continue to pursue ***** for any refund you feel is due.[FONT=&quot]

[/FONT]Please accept my assurances that all possible assistance is given to our cardholders to resolve any problems they may have however, I regret that in this instance I am unable to intervene.[FONT=&quot]

Also they claim that the phone number strarting with 0845 is free. Is that so?

    Pretty sure the majority of banks take this viewpoint, and it has been discussed here in the past, you make your CC payment to Paypal, Paypal then pay the seller.

    The CC issuer has no connection to the sale on Ebay, merely the Paypal funding.

    Probably not the answer you were hoping for.

    For ebay purchases you are covered by paypal anyway. But yes most CC companies wont

    HSBC did start a claim for me on a paypal paid for item once, however, as paypal protection is now 100% as long as you follow the rules then there isn't really any need for the CC company to be involved.

    OP, what happened when you tried a paypal chargeback, was this an ebay purchase and how long ago was it?

    It's too late for PayPal, they have only 45 days window to make a complaint. I received that item from China after more than a month of waiting. I missed the opportunity to complain to PayPal.
