  • yes, that half the battle, getting someone from the call centres that know what a das is and the law and rules regarding it,its beyond a joke when they hassle you,but a phone call from"the people upstairs"at my distributers office seemed to do the trick,my wife had creation finance sending here a letter saying they were going to call at out home this week,i plan to take this further as i see this as a threat, although i dont think they would have got past our guard dog.

the rule is simple, anyone comes to your home, call the police, simple, dont let them in at all and keep your door locked, talk to them at the door and ask them to leave your property, get there car reg and call the police,if you have asked them to leave and they dont they are breaking the law, simple.

other than that everything is calmed down at this end,egg called me,i am on a das as well, but i put them straight and told them they were breaking the rules of the das by contacting me direct, told them to take it up with my distributer.,,claimed the the distributer had not beening sending payment,,,rubbish!,,,what do these people think we are, these as tricks to get you to pay something to account,,it very clear what there up to.

also you are not going to have healthy credit record on a das,you more thanm likely dont have a good one on your dmp,but on the das intrset and charges are frozen, though they may show on your bill dont panic, this is normal,at the end of the das term they will be writen off...creditors hate this das program,,if this really catchs on it means big problems for creditors as they want there money back asap and intrest and charges if they can get it,,,,maybe this is why asking for a FF quote some people are gettng huge amount of there dept writen off by creditors,,,lucky if you can do that and have come into some money,,but if you do learn a lesson,,try and stay dept free,,,like we plan to.
  • oh,and if anyone phones you ,remember get there name, there company, there dept, there phone number, there ext if possibe, and note the day and time of the call and ask for a ref number for the call from them, ask if the call is recorded also, they dont like this because this means they have to be very much on the ball with anything they tell you,you could also tell them they are being recorded, but if you are doing this you have to tell them and ask if they are still happy to go ahead with the call,if they ask why you are recording them tell them it for your own records in the event of a complaint against the company or the person your are talking with, they hate this, one girl hung up on us a few weeks ago when i asked if she would mind me recording the call, she flipt and hung up,it was funny!!!!

remember if you are getting hassle over the phone when on a das the law is on your side not theres......oh and ask them if they know what a das is,if they say yes ask them to explain how one works, and the OFT and AIS rules regarding this and contact with people on a das,,,,then listen to them stutter over the phone,,,,oh and when you ask them for there name,i have noticed no one gives there name clearly,,has any one else noticed this, they dont say there name clearly and they will never give you there second name....its a strange world!!
  • dont know about you NR problem, but ar you sure you told you money adviser about all the creditors you wanted on your das, double check and make sure NR is on the list, dont just presume,i am sure if it is missed it can be added in,check with your advisercheck, this may be an error not on your part.

dont worry about the BOS thing, its run of the mill as your credit score crashes to the ground, its normal.

MBNA,no if there on the das list then they have to come to the party, they will add intrest and charges on but as the das comes to an end these charges will be written off,but make sur there on the DAS list,i had an account with mbna credits cards and loan and everything is fine, though at the start they didnt like it at all.....sod then.
  • i was talking to a relative,he had worked in call centres that deal with chasing people with credit thats owed,he told me many firm work on a commision basis,so if the person even get you to pay a pound me will get a % of it,the more he collects on the phone from you the more he/she earns, they are trained it tactic te get people to crumble and cough up some payment or even the full amount,he told me some collectors even thought the know someone is on a repayment plan will call the person many times in a week just to sicken them into paying something to account, they will used any trick in the book often bending the rules and telling you lies, like we dont have the correct paper work or letters of authority to deal with creditor direct, its a scam, watch out.they are looking for people who dont know there rights and they are wanting to exployt(spelling)this when people are under pressure.

if you are on a dmp or a das, dont pay a penny over the phone to creditor,do it all through your distributer is the simple advise to every one he claims.

my relitive does not work at this call centre any more as he found th job very stressful as people often got upset on the phone,he says its a disgrace and the OFT need to get on top of this with more regulation, its simply bulling over the phone and there are 1000,s of people in the same boat and the number are growing at a huge rate every day,and there is nothing to be ashamed about it a sign of the times just now that we live in.

so there you go,straight from the horses mouth as they say.

    regards to all

Sounds like there is lots of DAS expertise here for me to call upon :j
Can anyone tell me if an unsecured loan with interest added at the beginning would qualify for a reduction in interest under the DAS scheme ?

    Thanks
  • Can't give you a definitive answer I'm afraid however, my A&L unsecured loan is included in my DAS at full value.

  • Can someone tell me how DAS works if a couple have joint debts but only one of them wants to go on a DAS.

It won't work - you need to take out two separate DASs (one each), or the lender will just pursue the non-DAS half of the loan for the full contractual payment. I've had to leave a joint loan out of the DAS for that very reason.:(
  • Started my DAS payments in January and have had Mercers DCA on acting for Barclaycard. They have called 3 times while I have been at work. First time my wife was out so they left a message. Following 2days she was in and answered - both times they asked for me and ended the call when she told them I wasn't in.

I also got a letter on Thursday from them which I have replied to with a copy of my letter from AiB confirming approval of my DAS application.

Will wait and see what happens next but your advice in your original post may come in handy.

    cheers

Well that seemed to do the trick. Latest statement received from Barclay Card yesterday and it now acknowledges the payments being made via my Payment Distributor and that I am to maintain payments per the agreement. Only one 'mystery' call, coincidently on Friday, which was ended when my wife told the caller I wasn't in.

I was going to start a new thread with this one, but its a variation on a theme.

My question those of you on DAS or with a good knowledge of how they work, do you think they hinder your ability to negotiate a F&F or not?

I'd really appreciate your views on this. Yes our DAS saved (is saving) our bacon, but I'm just wondering about the alternative.

    Thanks
