I was in a similar position, I work full time and am paid pretty well but my partner had been out of work for a while and not paid his NI contributions. The JSA wouldn't help him because I earn too much, no tax credits, council tax reduction or anything.

Essentially they expect your partner to support any deficit in your earnings above a certain level.

Have you put your details onto entitledto and see if it brings any tax credits up?

Check if you could claim JSA if you were unemployed, but with your partner working.

And if you could then simply give an ultimatum to the employer to either give you a suitable guaranteed set number of hours each week/month,
or to just terminate your contract and find someone else who can work zero hours.

This is what i did before, and there was no problem when i started signing on as the jobcentre are very understanding about zero hours contracts, since all you have to say is that the employer terminated your contract by cutting all hours,
no 'misconduct' elements are needed, and so wouldnt be sanctioned.
  • If your husband is working you will almost certainly not be entitled to Income-based JSa; he is supposed to subsidise you.

However, if your contract is terminated and you have paid the right amount of NI at the right time, you might be entitled to Contributions-based JSA, which lasts for six months and is not means-tested.

Any expenses, including childcare, will not be taken into account for either type of JSA.

If you and your husband can not earn enough to pay for your home then, like everyone else, find somewhere cheaper to live that is within your means. Or cut your expenditure - spend less on energy and food. I don't see what this has to do with benefits.
  • I was in a similar position a few years ago. But your income is assessed as a couple. I accepted that but I was cross because I got no JSA because I had been working part time previously. Well, in the end we had almost as much money with me staying at home and it wasn't worth the hassle anymore. We just had to tighten out belts and get on with it.

Have you looked for another job?
