David Lloyd Creche reduced hours

Hi,

I signed up to David Lloyd on a 12 month contract 6 months ago. The main reason I joined was it ran an onsite creche which was open Monday to Friday 9 to 5 and Saturday and Sunday 9 to 12. A total of 46 hours per week.

Recently these opening hours have been reduced to opening on 9 to 11 for four days, a total of 8 hours a week. This has resulted in the creche being oversubscribed and severely limiting the times during which I can attend.

As this is a huge change to operating practices, should I be able to get my remaining 6 months refunded either via my credit card or trading standards?

    I'm guessing but I'd imagine if the Creche facility is not materially part of your Membership contract but more of a seperate optional facility then I'd doubt you'll be able to get any refund. As above check what your contract says.

    The relevant concept is 'material change' to contract. I would think that the creche is a material part of the contract as the customer would presumably enquire availability of both gym and creche facility when booking and decide whether to go through with the booking according to the availability of both.

    As for material change, I don't know. It may be a bit borderline - it is the same ilk as a change in the opening hours of the gym itself.
