Is this redundancy

I have just been told that part of my job is being taken away from me and an entirely new job will be advertised in the company I work for to include the part that I did and a part that was outsourced to another company.
The company has deemed that the role I did that is being taken away from me took up 2.5 days and that I will remain with them on 2.5 days a week doing the other parts of my job description. I cannot financially afford to stay with my salary halved and feel like it’s a way of them getting me to resign without paying me redundancy.
I would be unable to apply for the new role as would include qualifications I do not hold (hence why part was previously outsourced)
Any advice?

I thought the way it was is that if a job is being taken away from you it is because it no longer exists. So if it no longer exists then no-one should be eligible to apply for it?

There is no reason why you can't apply for it I'd have thought. Since you can prove you already have the required qualifications to do the role.

If half your job has gone - then surely its a redundancy and they should pay you off??

I would have thought that they have either got to make you redundant or give you this new job. However - if you arent qualified to do the other half of the new job - then I would have thought that would only leave them with the redundancy option on the table.

Personally - assuming you dont want/cant do the new job then I would just say "I refuse to have my hours cut. I'm going to either carry on doing my job as before (on a full-time basis) or - if you say thats not possible - then you will have to make me redundant".

What they are doing is "trying it on" to see if they can make you do the half of your job that still exists. You've got to "sit tight" and insist that you are a full-timer and ONLY do full-time jobs - the ball is then in their court to either provide a suitable full-time job for you or make you redundant if they cant/wont.

Right now - I would give them a letter (and keep a copy yourself) stating that you have a full-time job at present/you only work on a full-time basis (put in suitable "legal type" terminology) and then you've covered yourself for having provably made it plain that you refuse to have an hours/paycut.

Its obviously the easy option as far as they are concerned to try and force the existing person (ie yourself) to their 2.5 days job - you are a known quantity - they know they have someone who can provably do that bit of their new job. If they can manipulate you into doing that - then they dont have to spend time/money recruiting a new person for that. As I dont know how much redundancy money you would be entitled to - I dont know to what extent that will be affecting their thinking.

So the role still exists its just that I will not be able to apply for it as I do not have qualifications. There have never been any issues with my work and appraisals have always stated that its being done well.
I therefore stay on half salary which I cant afford or walk with nothing which I cant afford.
Strangely if I were redundant I would be better off with my income protection.

Havent time to think much now - w**k beckons.

Check out the employment posts on a blog of mine and see what applies - I know I've got a link or two somewheres on there to work out what redundancy money would apply:

On the top right sidebar of websites - i have a link to the TUC Workers Rights webpages too.
  • Ceridwen - Thank you for your replies, the link you gave me is excellent.
Thanks I will have a good snuffle through the info and draft my letter this weekend.
