    Can someone please confirm the above, that the contract of Sale is not enforceable if there is not a contract of Finance in place?

    DFS have previously insisted that the documents must be signed in store. However, I have not been able to get into their store. They have just called me and want to bring the documents to my home tonight for signing.

    BUT, with all the delay, my wife has seen another (more expensive and strangely in DFS) suite that she loves. We would really like to withdraw the contract for the previous suite and purchase the new suite instead. (DFS have already said we couldn't change our order according to their rules)

    2. Questions:
    1. Can I withdraw the finance agreement before signing the new document, and hence also withdraw the contract of sale?
    2. If I am required to sign the document, can I insist on an inspection of the suite prior to delivery and reject it if there are any flaws (likely given it is DFS).

    Look, Seriously...with no insults, please dont contribute anymore to my thread. I am hoping someone with something helpful to add can contribute here.

    Basically, DFS did NOT lie to me, but they did give me a great deal of confidence that we would have this suite BEFORE christmas which is why we made the (perhaps hasty) decision to buy it.

    now, as a stroke of fortune (good or bad) DFS have lost the finance documents and need them resigning. I would like, if possible to negate, cancel, withdraw (delete as appropriate) from this contract and go back to the drawing board. It was after Christmas, and while we were waiting for our suite to be made that my wife found another suite which she would have rather ordered had we not been confident to get the first one before Christmas. The new suite is nearly 2x the price.

    I just need to know where I stand legally; DFS have said that if I dont sign the finance document, I am still in contract to purchase and they will seek to get the funds in another way. I presume this means court. Can they do it? Are they within their (legal) rights, or have they messed up and are really just scaremongering to get me to sign.

    If I do sign, do I have a right to inspect the suite prior to delivery and potentially reject it if there are any imperfections.

    I've no idea whether you have a case, either legally or morally... But are DFS really that desperate for a sale?? To force a customer to take receipt of, and pay for, goods that they don't actually want?? It's not like you've got the sofa and are refusing to pay.

    Just ignore them.
