Tax credits and non resident parent

Hi all, I am divorced and have lived with my partner (still married but separated), my two children and his son for three years. We claim jointly for tax credits for all 3 of the children and were receiving child benefit for them all, along with maintenance from my ex for my two via the CSA.
Access has always been every other weekend with the non resident parents - the rest of the time they live full time with us and we provide and care for them. Last february my partners estranged wife, decided to claim for tax credits claiming their son was living with her (he never has, she keeps moving house and is currently staying with family in a rented house). She was awarded the tax credits based on one phone call saying she was a single parent on low income, and since then we have been in dispute with the tax office(we are now awaiting the outcome of our appeal). We have provided every piece of evidence they have requested and been co operative throughout- we have nothing to hide with our legitimate claim. Now she has applied for the child benefit and we have been stopped this 'while it is investigated'. My partner put in a claim thru the CSA, but she told them she earns a minimal amount of money (this is despite owning her own business and having a lifestyle we can only dream about). She is now obv being chased by these agencies as we have reported the fraudulant claims and she is now coming to pick up the son without prior notice and insisting he stays with her over night( I assume to validate her claim now she is being chased up). We have been fighting since last Feb to get our benefits back and just keep being told it is being dealt with and that they are waiting on her replies. Surely she can just keep lying and coming and fetching her son so he is actually staying with her (albeit until the money is sorted when no doubt we won't see her for dust again). Financially this has made things very difficult.....is it worth seeing a solicitor? Any advice/comments would be appreciated. :confused:
