Ebay purchase gone wrong???

Hi everyone, I wonder if you can help me?

I won a pair of shoes on an ebay auction, In short I recieved them and they were not as described, seller said as new and they came with wear to the heels and a resole,which wasn't mentioned or pictured in the advert. The sizing though advertised as originally a 6, details were then added that item was actually a 5, and came marked as this, but was definatley a 6 when tried on. Item described as boxed, came boxed but not in thier original box, and to top it all I doubt their authenticity!

Anyway, I emailed seller,who got quite shirty, after I asked to retrun item to her for a refund, so after failed attempts at an amicable settlement got paypal involved in a dispute.

Then today, I get an email form seller telling me Im to have county court papers served on me, for holding monies from them?? Obviously paypal have frozen the a/c, I have paid them, but they claim i am witholding funds. They are in Scotland, I'm in england is it possible this can be done?? I've contacted paypal about the threats and they tell me just to ignore them, sellers havent responded to them yet, but I don't want to have to have any ccj hassle. Your comments,please.

    You will get written notification of any court proceedings in the post so the email is more than likely a bluff.

    In the first instance you should use the eBay/paypal complaints proceedure and wait and see what happens.
    These are my thoughts and no one else's, so like any public forum advice - check it out before entering into contracts or spending your hard earned cash!

    I don't know everything, however I do try to point people in the right direction but at the end of the day you can only ever help yourself!
  • Yes, idiot seller is claiming he/she is letting me know they have filed papers, I thought they had to try to work things out amicably first?
  • I would post this in Ebay section of the forum if you havent. You may get more responses there.

    I think it is a bluff and they are trying to scare you. Even if it is not you have not taken the funds Paypal have - they automatically hold them if there is a dispute. So i cannot see how they would have a case anyway :confused:

    Have you returned the shoes yet? If you havent when you do get them sent by special recorded delivery i know it is pricey but they will be fully trackable and signed for and covered by the higher insurance.

  • What make of shoes are they and how much did they cost if you dont mind me asking? If they are really expensive and you said you doubt there authenticity could you not take them to the brands shop and see if they are Authentic and if they are not ask them to confirm this in writing for you. You can then submit that to Paypal.

    let paypal sort it out,return the shoes by a fully tracked service and get your refund
  • I paid £180 for them, Christian Louboutin, I don't live anywhere near a stockist, mostly london, but I have some already and they are of a completely different compostion and quality to my own. Ebay/paypal say I should win based on the other problems alone, and havent asked for authenticity to be checked.
