Letter from Halifax What should i do now?????

Hi i recieved this letter from Halifax today about how they were not at fault for the charges due to the court ruling and wondered if anyone knows if there is anything i could do next to at least keep my complaint open as they say it will be closed in 8 weeks without any reply from me.
Im not in financial difficulty or anything but the money would really help or at least some of it.
Please help if you can.

  • Hi, we can't see your letter but I'm guessing it's the same one i got this morning... the standard "test case outcome" letter?

    I'm also wondering what to do now as I am in financial difficulty and could really use the money.

    Have you read the MSE article on reclaiming bank charges?

    Lots of good advice there, such as:

    A. They have eight weeks to deal with it and it's likely they'll be swamped. When your case is dealt with, it's likely to be thrown out if your argument was based on the premise of the OFT's original case, that the fees were disproportionate.

    Yet there is nothing stopping you complaining a second time based on the potential new legal arguments and you can always complain to the Ombudsman if you don't like your bank's response, and this is especially worth doing if you fit any of the Ombudsman's special criteria (see below).

    A. Much less likely than prior to the Supreme Court result, but not impossible. The strongest hope is for those who fulfill the Ombudsman's criteria above... still, the best thing to do is plan for getting nothing, but cross your fingers.

    We believe there is a strong legal case under the new arguments yet it is complex and it takes time for these things to play through. For money management's sake, its very important to assume you won't get a payout – though we hope there is still a chance.

  • Can you tell me if the Court result includes charges by Halifax of 28 and 30 pounds way back in 2003 as fair. I understand 35 is the fair charge for today so 7 years ago my charges I believe were in excess. So would I be within my rights to still persue my claim. Is there any solid info on this?

    You cannot challenge the level of the charges but the fairness of them. The arguments are a lot more in depth.
