Re-reclaiming Help for Bank Charges

Hi all, hope all is ok.

I had a claim with Lloyds for just over £5000 of bank charges. This case was being dealt with and I recieved the £750 'Goodwill Gesture' which I accepted via letter only in partial settlement to the amount claimed.

Then the Test Case began, at which point Lloyds replied to the letter accepting the Goodwill Gesture and told me they had concluded my complaint, referred to the Test Case, insisted the charges were simply 'service fees' i agreed to, insisted those fees were fair and valid and declared that the complaint was therefore settled.

A year went by and after the 2 Judges sided with the OFT on assessing the fairness of the charges I wrote to them again but got no reply.

I have been reading the Ombudsmans official methods of practice for claims made using 'template letters' and the gist of it is that they will be rejected as the complaint does not cover the individual circumstances of the claimant, nor does the broad aspect of the template letter include specific information of the claimants finances, or how bank charges directly affected their finances.

So now i am wondering if i should write to Lloyds again, as the charges were detrimental to my current state of financial hardship, and ask for my money back?
Adding to the letter the effect the charges had on not only my finances but also to my life and my health due to the stresses involved with being deprived of money every month with the 'snowballing' effect of recurring charges.

In addition, is my understanding that banks that were dealing with claims were obliged to respond to claimants within 8 weeks of the Supreme Court verdict correct?
That 8 weeks expires next week and I have not heard anything from Lloyds regarding my complaint.

Do I bother writing to Lloyds or do I contact the Ombudsman with regards to the complaint?

  • I have also noticed that Abbey are planning to charge me a £35 charge because a standing order that is paid weekly every friday wasn't paid. It should have been paid on 25th December yet in the letter they've sent they say the date it wasn't paid was 29th December.
    Why didn't the bank take the money as per the standing order instructions. It's an electronic automated thing.
    I looked at my statement and there is no record of the payment being made on the 29th, nor on the 25th. In fact it didn't actually come out until the 6th January, then another on the 8th.

    Santander just informed me I have to go down the route of making a complaint via letter.

    Anyone got any advice for either of these questions?

    Here goes, my post in this thread will attract the usual mob here, and liven things up for you :)

    25th December was a bank holiday if you had failed to notice. So was Monday the 28th (ilo Boxing day on Saurday 26th)
    So any SO should have been actioned on the next working day i.e 29th December.

    An unpaid standing order doesn't show on statements as it never leaves the account.
