Unfair Charges on Vanquis Card - Debt being chased by Cahoot

I took out a Vanquis Credit Card in 2006. It started out with a 500.00 limit which was rapidly increased to 1500 once i started using it. I found the monthly repayments unmanagble as the interest was massive, i was paying around 60.00 per month and of that only about 20.00 was actually coming off my balance, the rest being interest payments. I then lost my job and neglected the repayments, Vanquis started adding 35.00 overlimit and late payment fees totalling at least 70.00 every month. The debt now stands at about 2500 and has been sold to a company called Cahoot who pester me constantly to make repayments to them that i cannot afford. I have a few questions im hoping you guys can help me with regarding this situation:

Firstly, I wish to dispute this entire debt because the majority of it is made up of "unfair" charges. Would i need to contact Vanquis or Cahoot to air this grievance. should i make a claim for my unfair charges to be refunded to me? If i was successful in my claim would the money from Vanquis be paid directly to me or would it go striaght to Cahoot and id be liable for the rest? Also, if the debt is being disputed by me would this mean it becomes unenforcable by Cahoot?

Any info or advice would be grateful received.

  • You need to send a subject access request to Vanquis and you need to read the guide to reclaiming credit cards. Furthermore, you need to tell the DCA(cabot, I suspect rather then Cahoot) that you are disputing the debt with the original creditor and are seeking further information from them before you are willing to sort out a payment plan.
    Once you have the statements post up.

    If there is a genuine dispute they should put a hold on collection activities while the dispute is resolved.
